BETA128 LLC ("Company," "we," "us," "our") is a global AI software company that provides intelligent agent platforms — including chat agent services, customizable agent personalities, and agent skill modules — for startups and businesses. We operate the BETA 128 platform at beta-128.uk. BETA128 LLC is the data controller for personal data collected through our website and services.

2. What Data We Collect

We collect the following categories of personal data:

  • Account data: Name, email address, company name, and password hash when you register.
  • Billing data: Payment details are processed directly by our payment processor (Stripe). We do not store full card numbers. We retain billing address and transaction records.
  • Usage data: Log files, IP addresses, browser type, pages visited, feature usage, and session duration — collected automatically when you use our services.
  • Communication data: Messages you send us via the contact form or email support.
  • Customer data: Content, documents, or data you upload to configure your AI agents ("Customer Data"). This data belongs to you.
  • Conversation data: Interactions between end-users and your deployed AI agents, used to provide the service and improve model quality (see Section 5).
  • Cookies and tracking: Session cookies, analytics cookies, and preference cookies (see Section 8).

3. How We Use Your Data

We use your personal data to:

  • Provide, operate, and maintain the BETA 128 platform and services.
  • Process payments and manage your subscription.
  • Send transactional emails (account confirmation, invoices, service alerts).
  • Respond to support requests and communications.
  • Improve our AI models, platform features, and user experience.
  • Comply with legal obligations and enforce our Terms of Service.
  • Detect and prevent fraud, abuse, and security incidents.
  • Send marketing communications where you have given consent (you may opt out at any time).

4. Legal Basis for Processing (GDPR)

For users in the European Economic Area (EEA) and UK, we process data under the following legal bases:

  • Contract performance: To provide the services you have subscribed to.
  • Legitimate interests: For security monitoring, service improvement, and fraud prevention.
  • Legal obligation: Where required by applicable law.
  • Consent: For marketing communications and non-essential cookies.

5. AI Training & Customer Data

Your Customer Data (documents, knowledge bases, and configuration data you upload) is used solely to provide you with the service. It is not used to train our base AI models or shared with other customers.

Conversation data from your deployed agents may be used in anonymized, aggregated form to improve overall model quality, unless you opt out in your account settings or request a Data Processing Agreement (DPA) that restricts this use. Enterprise customers may request complete data isolation.

6. Data Sharing & Third Parties

We do not sell your personal data. We share data only with:

  • Stripe: Payment processing. Stripe is PCI DSS compliant. See Stripe's Privacy Policy.
  • Cloud infrastructure providers: For hosting and data storage (e.g., our infrastructure partners operating under data processing agreements).
  • Analytics providers: For anonymous usage analytics to improve our platform.
  • Professional advisors: Legal, accounting, and auditing professionals bound by confidentiality obligations.
  • Law enforcement: Where required by valid legal process or to protect rights and safety.

7. Data Retention

We retain account data for as long as your account is active and for 30 days after closure. Billing records are retained for 7 years as required by applicable financial regulations. Conversation logs are retained for 90 days by default; Enterprise customers may configure custom retention. You may request earlier deletion as described in Section 9.

8. Cookies

We use the following types of cookies:

  • Essential cookies: Required for the platform to function (session management, authentication). Cannot be disabled.
  • Analytics cookies: Anonymous data on how visitors use our site. You may opt out.
  • Preference cookies: Store your settings and preferences. You may opt out.

You can manage cookie preferences through your browser settings or our cookie consent banner.

9. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

  • Access: Request a copy of the personal data we hold about you.
  • Rectification: Correct inaccurate or incomplete data.
  • Erasure: Request deletion of your personal data ("right to be forgotten").
  • Portability: Receive your data in a machine-readable format.
  • Objection: Object to processing based on legitimate interests.
  • Restriction: Request restriction of processing in certain circumstances.
  • Withdraw consent: Where processing is based on consent, withdraw it at any time.

10. International Data Transfers

As a global company, your data may be processed in countries outside your jurisdiction. Where data is transferred outside the EEA or UK, we ensure appropriate safeguards are in place, such as Standard Contractual Clauses (SCCs) or equivalent mechanisms.

11. Security

We implement technical and organizational security measures including: TLS encryption for all data in transit, AES-256 encryption for data at rest, role-based access controls, regular security audits, and SOC 2 Type II compliance processes. No system is 100% secure; in the event of a data breach affecting your rights, we will notify you within 72 hours as required by applicable law.

12. Children's Privacy

Our services are not directed to children under 16. We do not knowingly collect personal data from children. If you believe a child has provided us with personal data, contact us immediately at support@beta-128.uk.

13. California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

  • Right to Know: Request disclosure of the categories and specific pieces of personal information BETA128 LLC has collected about you, the sources, the business purpose, and the categories of third parties with whom it is shared.
  • Right to Delete: Request deletion of personal information we have collected, subject to certain legal exceptions.
  • Right to Correct: Request correction of inaccurate personal information.
  • Right to Opt-Out: BETA128 LLC does not sell your personal information. We do not share personal information for cross-context behavioral advertising.
  • Right to Non-Discrimination: You will not receive discriminatory treatment for exercising your CCPA rights.
  • Right to Limit Use of Sensitive Information: Where applicable, you may direct us to limit use of sensitive personal information to what is necessary to provide the services.

14. Data Processing Agreements (DPA)

Where BETA128 LLC processes personal data on behalf of a customer as a data processor (e.g., personal data contained within Customer Data uploaded to the platform), we are prepared to enter into a Data Processing Agreement that satisfies the requirements of the GDPR, UK GDPR, and other applicable data protection laws. Enterprise customers may request a DPA by contacting support@beta-128.uk.

15. Changes to This Policy

BETA128 LLC may update this Privacy Policy periodically. Material changes will be communicated via email to the address associated with your account and/or via a prominent notice on our website at least 14 days before the change takes effect. Continued use of our services after changes constitutes acceptance. We will maintain an archive of prior versions upon request.
